Birdeye Data Services ("BDS", "we", "our" or "us") operate an online data service located at https://bds.birdeye.so/ which you may purchase products and services ("BDS Products").
These Terms of Use apply to the content and functionality of https://bds.birdeye.so/ and to the BDS Products.

1. Information That You Provide to Us

The Customer ("you") may provide us with information about yourself when you visit bds.birdeye.so. We may need to send you emails and messages to verify your identity, provide important information, or updates about the BDS Products you use or may be interested in using. You authorize us to send these messages when you provide your contact details. Standard text or data charges may apply. Disabling text notifications may impact security.

2. Products, Content, and Specifications

Details of BDS Products available for purchase are set out on bds.birdeye.so. Features, specifications, and prices of products and services are subject to change at any time without notice. Delays in delivery may occur, and BDS will notify you of any changes. Products ordered must be used lawfully.

3. Subscriptions

a. Monthly Subscription Terms: Monthly subscription details are provided at the time of purchase. By purchasing, you agree to those terms.
b. Additional Credits: If monthly credits are exhausted, additional credits will be consumed, resulting in extra charges.
c. Free Trials and Promotional Periods: There is no trial, please read the package details carefully. You may cancel during the promotional period; otherwise, billing begins at the end of the period.
d. Cancellation: Subscriptions will auto-renew unless canceled. Cancellation is effective immediately or at the end of the cycle based on client selection. If payment is not made for overage costs, the upcoming cycle, or if credit limits are exceeded, your account may be canceled after a 24-hour grace period.
e. Custom Traces: Subject to approval, custom traces are available by request.

4. Your Account and Permitted Users

You must register for an account to use BDS Products. You represent that the information you provide is accurate and agree to keep it up to date. "Permitted Users" are those authorized to use BDS Products under your account. You are responsible for any activity under your account.

5. Customer Responsibilities

By using BDS Products, you agree to:
(i) Be responsible for all usage and fees,
(ii) Use products according to terms and laws,
(iii) Prevent unauthorized access,
(iv) Notify BDS of unauthorized access,
(v) Not sublicense or resell products,
(vi) Not interfere with product operations,
(vii) Not reverse engineer or derive source code,
(viii) Not modify or create derivative works.

6. Usage Alerts

Alerts are sent to inform you of API credit usage. Credits do not roll over and are non-transferable. Overages are billed separately. Real-time usage can be monitored in the user portal.

7. Billing

API credits are included in the subscription and billed monthly. Overages are billed at the overage rate.

8. Refunds

Payments made are non-refundable and we do not provide refunds or credits for any services already paid for.

9. Security and Permissible Use

You are responsible for the security of your account. Notify BDS of security breaches. Rate limits may be applied. Use of BDS Products must comply with applicable laws.

10. No Warranties

bds.birdeye.so and BDS Products are provided "as is" without warranties. Use is at your own risk, and BDS disclaims liability for any issues arising from use.

11. Limitation of Liability

BDS is not liable for any indirect, punitive, incidental, or consequential damages. Total liability is limited to the greater of the fees paid by you in the last three months or $20.

12. Modification and Severability

BDS may change these Terms at any time by posting updates on the website. Continued use of services constitutes acceptance of updated terms.

13. Testimonial Release

You agree to allow BDS to use your company name, logo, and testimonial as described here.
